Terms

Subscription terms & conditions

This is the terms and conditions for the use of Benington WiFi, provided to you by your "site" (the owner of the site who has asked us to provide WiFi connectivity). Any processing of your personal data is carried out in accordance with our hotspot privacy policy.

What we provide

The service gives you access to the internet (sending and receiving data through our network and the internet using technology installed directly to your premises) and helpdesk services. It's provided for business and consumer use.

When your service starts, ends, and your cancellation rights

The service starts when you're connected to the router or access point we provide. How long you can access it for depends on the subscription you've purchased, and your agreement ends when that subscription expires.

Using the service

The service requires a network name and password provided on install - it's your responsibility to keep this safe and secure. The service doesn't include connection from our network to any customer network, any services once you're connected to the internet, or any computer equipment to access the service or the internet. It may also be impaired by geographic, atmospheric or other conditions beyond our control.

We provide a telephone helpdesk (details on our website) - we may monitor and record calls for training and quality purposes. You agree to get any permission needed from someone else if you want to use the service where that's necessary, including in the UK. We have no control over, and don't examine, the information or content you send or receive over the service, and can't guarantee access to the internet or that the service will continue to be available.

You must not use the service, or allow it to be used, to break any law or licence/rights of others; to make offensive, indecent, menacing, nuisance or hoax calls, or cause annoyance or needless anxiety; to send, receive, upload, download or use offensive, abusive, indecent, defamatory, obscene or menacing material; or in a way we reasonably believe adversely affects the service for you or any other customer - including trying to circumvent website address blocking at the hotspot. We take this seriously: if we reasonably believe you've misused the service, we may suspend it or end your agreement immediately, without telling you first.

Any content, software or other copyright material supplied to you is for your own private or business use only - you mustn't copy, modify, publish, resell, transfer or supply it to anyone else.

Your responsibilities

You're responsible for making sure any equipment you use to access the service is suitable, adequately protected against threats such as viruses, worms and trojans, and used according to its instructions. Business customers also accept that the service depends on their own communications network being suitable. If you access content or software owned by others who require you to accept their own terms, you must keep to those too. You agree to fully compensate us for any claims or legal action brought against us by someone else because of your use of the service in a way that breaks these terms - we'll tell you about any such claims and keep you updated.

Security

You're free to add extra security such as firewalls on your own equipment. Due to the nature of the service, we can't guarantee its security against unlawful access or use, or the integrity, authentication and confidentiality of information you exchange over the internet (including card PINs) - you should make sure you have adequate security of your own. If you're given a network name and password, you must keep it confidential and secure, use it properly, and not exchange, transfer or sell it to any third party.

Other things we may need to do

For operational reasons we may occasionally need to interrupt the service (restoring it as quickly as we can), make minor changes to technical specifications such as data-transfer limits, or change the network name and password or disable access where required.

Our responsibility to you

We can't guarantee the service will never be faulty, or that it will be compatible with your equipment, software or communications network - using the internet is at your own risk. Unless these terms say otherwise, and to the extent permitted by law, we have no responsibility to compensate you (whether or not we're negligent) for direct financial loss, loss of profit, revenue, time, data, business or similar loss, or for any indirect or consequential loss or damage, arising from your use or inability to use the service. If you're a consumer, nothing here affects your legal rights relating to a faulty or wrongly described service, and if any limitation in this section is found unenforceable, the rest continue to apply.

Matters beyond our reasonable control

Sometimes we may be unable to do what we've agreed because of something beyond our reasonable control - lightning, flood, severe weather, fire, explosion, terrorist activity, government or other authority action, industrial disputes, or other similar reasons. In these cases we don't accept responsibility for not providing the service.

If you break this agreement

Other than for serious misuse, we'll normally give you a reasonable opportunity to put things right if you break this agreement. If you don't, we may suspend or end the service, and we'll tell you what needs to be done before we reinstate it. Choosing not to enforce a term on one occasion doesn't stop us enforcing it, or any other term, in future.

Refunds

We reserve the right to decline refunds where the refund is deemed unreasonable, or where the refund form is incorrectly filled out or contains incorrect information.

Other things we need to tell you

The terms of this agreement aren't enforceable by a third party under the Contracts (Rights of Third Parties) Act 1999. This agreement is governed by the law of England and Wales and subject to the non-exclusive jurisdiction of the English courts.
